RENTAL AGREEMENT
Terms and Conditions
Placing a booking with payment implies that the tenant has read and accepts this document on behalf of everyone in the rental group. By entering into this rental agreement, the tenant and the owner (that's us), agree to the following Terms and Conditions:
THE TENANT WILL:
- Provide the owner with the full name, address, workplace, home, work and cellphone numbers for the person(s) responsible for your group before arrival; or provide same for two persons when a non-family group of more than 10 singles/couples will be coming.
- Notify owner of exact total number of persons (adults and children) staying at the property and not increase this number without our knowledge and approval.
- Maintain the house and property in the same condition it was in upon arrival.
- Treat the house, contents and property in a respectful and responsible manner. This includes not playing ball games inside the house and not using excessive force or rough and reckless behaviour.
- Refrain from smoking anywhere indoors. If smoking is detected inside we will deduct a special cleaning surcharge of at least $200 from the security deposit.
- Not allow any open flame (e.g. candles) in the lower level.
- If smoking or drinking outside, dispose of all butts/bottles in a safe manner.
- Refrain from any substance abuse (drugs, pills, marijuana) and excessive consumption of alcohol.
- Not bring any flammable or explosive materials inside the house and not bring fireworks on the property without our prior approval.
- Not dispose of kleenex, paper towels, diapers or feminine hygiene products down toilets.
- Divide all garbage and sort returnable bottles and store only in garage with door closed.
- Pet owners are responsible for removal of all pet feces outside; clean-up and removal of any pet excrement or hairs inside.
- Not alter wiring, house structure, or furniture and appliances without our approval; furniture may be moved around as needed (lift, do not drag, and put back in place). Alterations or rearranging of contents may be considered damage and result in a deduction from the security deposit.
- Not remove mattress or pillow bedbug protectors
- Not tamper with or break into any locked space (in office or lower level) where we keep our personal items. If a private, locked space is broken into you will lose your deposit and may face criminal charges.
- Immediately inform the owner of any problems or accidents (contact list is posted on the property).
- Be responsible for any acts of malice, accidental or purposeful damage to property and equipment by tenant or tenant's guests.
- Accept responsibility for the actions and behaviour of all persons occupying the rental property, including visitors.
- Not allow the property to be occupied by any persons other than those intended by the contract.
- Accept that there are risks involved to persons due to wildlife, rural landscapes etc. that are each individual's responsibility and not hold the owner responsible or liable in any manner should an accident occur.
- Advance a refundable security/damage deposit with the booking payment, which will be credited back to you following your departure. Property is checked by staff after each departure for damage and/or missing items. Any discovery of either will be deducted from your security deposit.
- Upon booking, accept all terms and conditions as part of the agreement to rent our cottage, and acknowledge that these conditions apply to every person in the rental group.
- Have the right to cancel the contract at any time, with the following consequences: if longer than 6 months to arrival date, full refund minus administrative fee provided we have not turned down any serious enquiries on your dates; if less than 6 months to arrival date, minimum $500 fee with amount refunded dependent on our ability to re-rent your time period at our usual rate.
- Comply with the arrival and departure times outlined in the verbal or email confirmation.
- Acknowledge that there are extenuating circumstances in life, and work in a co-operative, reasonable and fair manner with the owner should such an event occur.
- Understand that failure to comply with any of the above constitutes termination of the rental agreement and the possible removal of all persons from the rental property without compensation or refund.
- Leave the house and yard in a clean and tidy state upon completion of rental: kitchen cleaned up, dishes in dishwasher, garbage and recycling in garage, barbecue tidy, floors swept, toys sorted and put away, outdoor litter picked up, etc. Please leave used beds unmade. We will handle towels, linens, bedding and any leftover food in the fridge.
NOTE: Deductions from the security deposit will occur for the following
reasons- structural damage, breakage other than minor, theft, if excessive cleaning required (including use of excess bedding, broken glass or littering outdoors, unsorted garbage, etc.), indoor smoking, use of fire extinguisher, leaving house filled with bugs, correcting alterations or moved furniture, or for other special services requested from owner. There is a minimum $50 handling fee for disposal of any non-recycled bags of garbage, or more than 6 bags of recycled garbage (returnable bottles or cardboard are exempt) and a $100 fee for 15+ bags left behind, etc. Charges may also be levied for failure to report fire or major equipment failures resulting in damage or excessive repair costs.
THE OWNER WILL:
- Provide the house, contents and property in clean and reasonable condition for your arrival as described.
- Solve any problems the tenant may have to the best of the owner's ability.
- Fix any mechanical, electrical, plumbing problem as quickly as possible upon being informed by tenant of such a problem.
- Be responsible for the cost of all repairs under acts of God, failure of equipment and items of that nature.
- Provide all of the inclusions as listed here or on our website.
- Provide a contact list for emergency use by the tenant while at the property.
- Refund any monies owed upon cancellation of contract by tenant subject to our cancellation policies.
- Refund (within two weeks) the tenant's security deposit upon inspection following departure and completion of contract. Any penalties or missing items will be described and deducted from security/damage deposit before refund.
- Acknowledge that there are extenuating circumstances in life and work in a co-operative, reasonable and fair manner with the tenant should such occur.
- Not accept any responsibility whatsoever for any personal injury of any type, for any reason while tenant is occupying rental property or on neighbouring properties.
- Have the right to evict and remove all persons from the rental property with no refund should the tenant (or anyone occupying the rental property during tenancy) fail to comply with the terms as listed above.
